Observed a thawing whole striploin of raw beef in plastic wrap, a container of diced raw chicken, and a bowl of raw shell eggs with broken shells stored on a shelf in a reach-in refrigerator above deep plastic containers of ready-to-eat (RTE) onions and daikon radish. Observed a box of raw shell eggs stored on a shelf directly over a box of RTE lemons in the walk-in refrigerator. All raw animal proteins must be stored below RTE foods and stored according to cooking temperature at all times to prevent cross contamination. PIC properly stored all raw animal proteins according to the final cooking temperature based on the cooking parameters in § 3-401.11 of the Food Code. Visible existing contamination of the RTE foods was not observed. Corrective Action: Corrected at time of inspection.

Observed in the back prep table a spicy tuna mix and crab mix to be an internal temperature of 48*F to 50*F. Per PIC the 2 items were made and placed in the table approximately 30 minutes prior to inspection. Discussed with PIC TCS foods must be cooled in: uncovered/loosely covered, shallow containers less than 4 inches deep, in equipment designed to rapidly cool, by using an ice bath, by using ice as an ingredient, or another effective means. Adequate refrigeration would be the walk-in refrigerator/reach-in or the freezer units. PIC relocated the spicy tuna and the crab mix to the walk-in refrigerator to properly cool at time of inspection. Corrective Action: Corrected at time of inspection.

Also observed a dirty butcher knife stored away as clean. Discussed with PIC all utensils and equipment shall be cleaned to sight and touch. PIC took butcher knife to be cleaned. Observed at sushi case unit with an ambient temperature of 45*F measured with a min/max thermometer. Observed several TCS items at temperatures of 48*F to 50*F measured with a probing thermometer. Per person in charge (PIC) the items were placed in the unit 1 hour prior to inspection. Discussed with PIC except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. Eggs not treated to destroy Salmonellae can be stored in equipment that maintains an ambient air temperature of 45°F or below. The TCS items improperly cold held (cooked eel, albacore tuna, cream cheese, smoked salmon, crab stick, yellowtail, and tuna) were relocated to alternative functioning refrigeration unit to rapidly cool to 41°F at time of inspection. PIC stated the rice and shrimp are on time as a control but no time stamp or log was present. Discussed that when time as a control is used, foods must be used or discarded within 4 hours and cannot be cooled down, reheated or otherwise repurposed.
