Observed individually packaged grab-and-go ice cups with no label. Per person-in-charge (PIC), ice is portioned on-site. All packaged food labels must include the following items: (1) the common name of the food, or absent a common name, an adequately descriptive identity statement; (2) If made from two or more ingredients, a list of ingredients and sub-ingredients in descending order of predominance by weight, including a declaration of artificial colors, artificial flavors and chemical preservatives, if contained in the food; (3) an accurate declaration of the net quantity of contents; (4) the name and place of business of the manufacturer, packer, or distributor; (5) the name of the food source for each major food allergen contained in the food unless the food source is already part of the common or usual name of the respective ingredient; (6) except as exempted in the Federal Food, Drug, and Cosmetic Act § 403(q)(3) -(5), nutrition labeling as specified in 21 CFR 101 -Food Labeling and 9 CFR 317 Subpart B Nutrition Labeling; and (7) for any salmonid fish containing canthaxanthin or astaxanthin as a color additive, the labeling of the bulk fish container, including a list of ingredients, displayed on the retail container or by other written means, such as a counter card, that discloses the use of canthaxanthin or astaxanthin. Corrective Action: Correct prior to next routine inspection. 6-501.11 - Core: Repairing -Premises, Structures, Attachments, and Fixtures-Methods Addl Notes: Observed holes in the walls throughout the walk-in refrigerator. Also observed multiple broken floor tiles throughout the walk-in. All floors, walls, and ceilings must be maintained and repaired such that it is smooth and easily cleanable. Observed freeze dried candy under the "King Candy" brand. There was no label indicating the information about where it was produced, contact information, and the person in charge was unable to provide an invoice. All food must be obtained from an approved source as defined by law. Person in charge indicated they would find the invoice and in the meantime, they would remove the candy from the sales floor. Candy was removed from sales floor. Corrective Action: Correct prior to re-inspection 07/11/24 to find invoice and evaluate if it is from an approved source.

Observed the following time/temperature controlled for safety foods with internal temperatures between 44*F - 45*F in walk-in refrigerator: bottled milk, sour cream, and shredded cheddar cheese. Person in charge indicated these foods had been in the unit since yesterday and they did not verify the temperature of the unit. The measured ambient temperature of the unit was 44.6*F. Except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. Eggs not treated to destroy Salmonellae can be stored in equipment that maintains an ambient air temperature of 45°F or below. All TCS foods improperly cold held were discarded by PIC at time of inspection. Corrective Action: Corrected at time of inspection.

The packaging indicated the contents were Dulce Enchilados and had a phone number; the name of the business was too blurry to determine. The phone number was called but no one answered. Person in charge indicated they did not know where they were made or the name of the business. Food shall be obtained from sources that comply with law: all foods (except for whole intact agriculture products) sold in the establishment must come from an approved source (i.e. a permitted/inspected establishment/facility or from a registered cottage law producer). Inspector informed person in charge the Dulce Enchilados would be under a true embargoed until the name of the company and where the Dulce Enchilados were prepared could be determined.
