Observed dairy butter stored in multiple stainless steel containers at a temperature of 70 F. Per PIC, item had been out the day prior to inspection. PIC was informed except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. Also discussed implementing time as a control policy for butter. All TCS foods improperly cold held were discarded by PIC at time of inspection. Corrective Action: Corrected at time of inspection.

Observed cooked chicken drumsticks and cooked meatballs past 7 days datemarking in reach-in unit located opposite of cookline. PIC stated both items were frozen on day of prep and pulled from the freezer on the marked thaw date. Cooked chicken drumsticks observed with prep date of 08/17 and pulled date of 09/04; item was to be discarded by 09/09. Cooked meatballs observed with prep date of 09/05 and puled date of 09/08; item was to be discarded by 09/13. Suggested PIC to include discard date to ensure all staff can easily identify cooked food items that are past 7 days. All RTE/TCS foods past 7 days of preparation were discarded by PIC at the time of inspection. RTE/TCS foods requiring date marking must be date marked within 24 hours and sold or discarded after 7 days (including the day it was made as day 1). Person in charge confirmed that these were the dates they were packaged in reduced oxygen packaging and that they had not been removed from the packaging since that date. Person in charge was informed that time/temperature controlled for safety foods that are reduced oxygen packaged in the establishment must either be removed from the packaging within 48 hrs. or they may acquire a variance with Maricopa County Environmental Services. Person in charge was informed because all of the foods listed above were packaged more than 48 hrs. before inspection they may not be fit for human consumption due to lack of control of harmful pathogens and thus were being embargoed. Person in charge collected all of these foods into a container, placed a label indicating "do not use" on the container, and indicated that rather than throwing the food away the owners would like to take it home for their own personal consumption; person in charge is aware they cannot sell/serve the foods listed above. A picture was taken of the container and inspector will return 02/02/24 to ensure these foods have been removed from the premises.
