Due to the violations noted on this inspection report, County legal action may result from this inspection.Report emailed. **Discussed: 1. cleaning procedure and frequency for non-TCS food contact surfaces. 2: using time as a control, ice baths, smaller containers, or placing cut tomatoes further from door and closer to fan in walk-in refrigerator. 3. adjusting walk-in refrigerator door to fully self close. **Observed walk-in refrigerator with an ambient air temperature at a minimum of 43*F, via min/max thermometer. All TCS food was cold holding at 41*F or below. Discussed with PIC having walk-in refrigerator inspected to ensure it is properly functioning.

Observed sliced tomatoes in uncovered container with internal temperature between 53*F - 57*F in walk-in refrigerator and on prep line. The person in charge (PIC) indicated they were sliced between 8:00AM and 9:00AM and did not monitor their internal temperatures. PIC states whole tomatoes are kept refrigerated, washed with cold water, sliced, and put in walk-in refrigerator to cool down. TCS foods prepared from cold or ambient room temperature ingredients must be cooled from 70°F to 41°F within 4 hours. All TCS foods improperly cooled were discarded by PIC at time of inspection. PIC stated instead of utilizing prep table to cool, they have started using walk-in refrigerator. Discussed use of ice bath in deep pans and placing cut tomatoes in one layer in metal containers for them to effectively cool to 41*F within 4 hours. Corrective Action: Corrected at time of inspection. REPEAT VIOLATION (3RD CONSECUTIVE)

The person in charge indicated they did not take internal temperatures today of these foods and they had been in the unit since yesterday. The measured ambient temperature of the unit was 46.4*F. All TCS foods improperly cold held were discarded by PIC at time of inspection. Except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. Eggs not treated to destroy Salmonellae can be stored in equipment that maintains an ambient air temperature of 45°F or below. Corrective Action: Corrected at time of inspection.

Please address the following items prior to the next routine inspection: 1) Provide ASSE 1055 A internal air gaps to the chemical dispensers. 2) Replace or refinish all rusted shelving units in the walk-in cooler. 3) Caulk all wall holes, as needed, with silicone. 4) Provide a covered trash receptacle in the women's restroom for feminine hygiene product disposal. 5) Caulk-in all escutcheon plates and plumbing penetrations throughout the facility with silicone. OC inspection for a Class 3 10+ E&D permit was conducted with manager Selena P. by appointment. The establishment was open and operating at time of inspection. This establishment/operation has demonstrated sufficient compliance to proceed with the issuance of the permit. To complete the permitting process, issuance of this permit, and begin operation, the applicant must first submit payment of the annual operating permit fee to the Department’s Administrative Services. Fees paid up to this inspection approval do not include the annual operating permit fee. PAYMENT with a credit/debit card can be made via phone at 602-506-6824, Option 2. Per MCEHC Chapter I, Regs 4 & 5, no person shall conduct an operation or operate an establishment for which a permit is required without holding the necessary and valid permit to do so.
