After discussion with the person in charge, it has been determined that the root cause of the violation was training staff (a policy issue, verification breakdown), which resulted in the violation.

Inspector's notes

Observed the following time/temperature controlled for safety (TCS) food items in produce cooler with an internal temperature between 45*F-48*F: cut watermelon, cut cantaloupe, cut honeydew, cut lettuce, cut cabbage, and pre-cut salad mix. Ambient air temperature of walk-in cooler was at 47*F initially, but later dropped to 43*F. Person in charge (PIC) indicated all items had been prepped/received the day prior and internal temperatures of food items had not been verified that day. All TCS foods improperly cold held were discarded by PIC at time of inspection. Except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. Eggs not treated to destroy Salmonellae can be stored in equipment that maintains an ambient air temperature of 45°F or below. PIC stated a work order will be placed to have walk-in cooler inspected/repaired to ensure food is maintained at 41*F or below. Corrective Action: Corrected at time of inspection. REPEAT VIOLATION (2ND CONSECUTIVE).

#22 — Proper Cold Holding TemperaturesPriority3-501.16

Inspector's notes

Observed TCS foods in a refrigerated retail display case with internal temperatures ranging 54*F-60*F. These TCS foods included masa (labeled keep refrigerated), nixtamal (cooked corn), sliced bacon, cooked pig feet, and hot dogs (see embargo form for all TCS foods). The ambient temperature of the unit was 59.0*F, measured using min/max thermometer. PIC stated that the unit was below 41*F about 5 hours prior to inspection. Informed PIC that due to it being over four hours since the unit was last checked, the TCS foods need to be discarded. PIC instructed employees to discard all the improperly held TCS foods. All improperly held TCS foods were discarded at time of inspection. Food was embargoed. PIC agreed to not use the unit for the display of TCS foods until the unit is capable of keeping the product at 41*F or below. All TCS foods improperly cold held were relocated to alternative functioning refrigeration unit to rapidly cool to 41°F at time of inspection. All TCS foods improperly cold held were discarded by PIC at time of inspection. Corrective Action: Corrected at time of inspection.

Observed packages of raw chorizo and raw bacon sitting over fully cooked hot dogs and packages of sliced cheese for retail sale. Informed PIC that the raw animal proteins need to be store according to cooking temperature and not above any ready-to-eat foods (RTE). PIC relocated and properly stored the raw animal proteins at time of inspection. Provided PIC with the food storage chart document via email. PIC discussed proper storage of these products with the employees in charge of stocking that section. All raw animal proteins must be stored below ready-to-eat (RTE) foods and stored according to cooking temperature at all times to prevent cross contamination. PIC properly stored all raw animal proteins according to the final cooking temperature based on the cooking parameters in § 3-401.11 of the Food Code. Corrective Action: Corrected at time of inspection.
