Observed no consumer advisory disclosure or reminder on the menu. The items that can be served undercooked are the burgers and some breakfast items. Any food item that can contain a raw or undercooked protein must have a proper consumer advisory informing the consumers of the risks of foodborne illness. Reviewed proper consumer advisory options with manager. Instructed the establishment to update their menu's with the proper consumer advisory prior to re-inspection on Monday the 17th.

In the walk in freezer observed various boxes, bags, and trays of foods open without protection like lids or covers. Foods included, turkey patties, battered mushrooms, falafel, and a gyro spit. In the walk in cooler, observed a pan of beans without a lid. Manager put lids and wrap on foods to keep them protected from contamination.

In the hot holding bin, observed a pan of pinto beans at 105*F - 125*F. Per manager, they were already reheated in a pot on the stove and placed into the hot box to hot hold. Per manager, beans had been placed there for 20 minutes. Beans were reheated to 165*F and placed back in the hot holding unit. Also observed a pan of cooked sausages at 75*F. Per manager they were cooked and placed in the pan to hot hold around 7am this morning. Sausages were embargoed.

Observed cut tomatoes range between 45*F - 48*F located in cold top of cold holding unit on cook line. Per person-in-charge (PIC), tomatoes had been left in cold top overnight and had been taken out for an unknown amount of time in the morning. PIC voluntarily discarded cut tomatoes at time of inspection. Except during preparation, cooking, cooling or when time is used as a control, all TCS foods must be maintained at 41°F or below.
