Observed a variety of foods stored for sale such as popsicles and ice cream bars without proper labeling and trail mix from bulk mix sold in portioned containers with no label. All packaged food labels must include the following items: (1) the common name of the food, or absent a common name, an adequately descriptive identity statement; (2) If made from two or more ingredients, a list of ingredients and sub-ingredients in descending order of predominance by weight, including a declaration of artificial colors, artificial flavors and chemical preservatives, if contained in the food; (3) an accurate declaration of the net quantity of contents; (4) the name and place of business of the manufacturer, packer, or distributor; (5) the name of the food source for each major food allergen contained in the food unless the food source is already part of the common or usual name of the respective ingredient; (6) except as exempted in the Federal Food, Drug, and Cosmetic Act § 403(q)(3) -(5), nutrition labeling as specified in 21 CFR 101 -Food Labeling and 9 CFR 317 Subpart B Nutrition Labeling; and (7) for any salmonid fish containing canthaxanthin or astaxanthin as a color additive, the labeling of the bulk fish container, including a list of ingredients, displayed on the retail container or by other written means, such as a counter card, that discloses the use of canthaxanthin or astaxanthin. Inspector's notes

Observed shallow (<4" deep) covered containers of cooked red onions and hard boiled eggs in prep-style refrigerator and walk-in refrigerator (respectively) cooling at 81-84 degrees Fahrenheit. Per person in charge (PIC), items began cooling 30 minutes prior to inspection, which is within parameters for proper cooling times and temperatures. TCS foods must be cooled in: uncovered/loosely covered, shallow containers less than 4 inches deep, in equipment designed to rapidly cool, by using an ice bath, by using ice as an ingredient, or another effective means. PIC moved red onions to walk-in and lids were removed from both containers to facilitate rapid cooling. Inspector verified more rapid cooling. Corrective Action: Corrected at time of inspection.

Inspector's notes

Observed a box of bagged soup and a box of bagged chili sitting on the floor of the walk-in freezer. Additionally observed a 5-gallon bucket of pickles on the floor of the walk-in cooler. Discussed with PIC that food must be stored at least 6 inches off the ground at all times to prevent contamination from the premises. Corrective Action: Correct prior to next routine inspection. 3-307.11 - Core: Miscellaneous Sources of Contamination Addl Notes: Observed a container of shredded lettuce nestled inside a larger container of shredded lettuce in the reach-in cooler beneath the prep table such that the outside of the smaller container was touching the lettuce in the larger container. Discussed with PIC keeping the containers separate as to prevent contamination to food from the outside of the containers. Corrective Action: Corrected at time of inspection.

PRIORITY VIOLATION-5-203.14, P: Backflow Prevention Device, When Required Observed coffee machine near front counter directly connected to facility water line with no backflow prevention device. Install ASSE 1022 backflow preventers devices between water line source and coffee machines. Also observed a reverse osmosis system connected to water line. Person in charge (PIC) stated the RO system is not used and they plan to disconnect. If RO system remains, install a Reduced Pressure Principle Zone Assembly (RPZ) backflow preventer between water source and RO system. Ensure there is no copper/brass fittings downstream of RPZ backflow preventer. Provide backflow test report. Observed chemical dispenser for 3-compartment sink and near mop sink without an approved air gap. Replace chemical dispenser with ASSE 1055A internal air gaps. Observed brass/copper fittings downstream of Reduced Pressure Principle Zone Assembly (RPZ) backflow preventer for carbonated soda fountain. No brass/copper fittings can be installed downstream of a backflow prevention device attached to carbonated soda system. Replace brass/copper fittings with stainless steel or PVC type fittings.
