All packaged food labels must include the following items: (1) the common name of the food, or absent a common name, an adequately descriptive identity statement; (2) If made from two or more ingredients, a list of ingredients and sub-ingredients in descending order of predominance by weight, including a declaration of artificial colors, artificial flavors and chemical preservatives, if contained in the food; (3) an accurate declaration of the net quantity of contents; (4) the name and place of business of the manufacturer, packer, or distributor; (5) the name of the food source for each major food allergen contained in the food unless the food source is already part of the common or usual name of the respective ingredient; (6) except as exempted in the Federal Food, Drug, and Cosmetic Act § 403(q)(3) -(5), nutrition labeling as specified in 21 CFR 101 -Food Labeling and 9 CFR 317 Subpart B Nutrition Labeling; and (7) for any salmonid fish containing canthaxanthin or astaxanthin as a color additive, the labeling of the bulk fish container, including a list of ingredients, displayed on the retail container or by other written means, such as a counter card, that discloses the use of canthaxanthin or astaxanthin. Note a 3-day reinspection is required.Predefined Comment: Due to the violations noted on this inspection report, County legal action may result from this inspection.Establishment was observed operating outside the scope of their approved operating permit in violation of MCEHC Chap. 1, Reg. 4(a). Observed establishment to be selling hollow; a Somalin dessert made of sugar, seasoning, corn starch, and oil. Observed 10 ziplock bags of hollow available for sale. Upon questioning, PIC stated hollow is obtained from a restaurant in Minnesota, shipped to establishment, and packaged into ziplock bags at establishment for retail sale. To continue activities a food processer permit is required. Hollow will be taken home with owner. A 3 day follow up will be required with a written statement from establishment that activities will cease.

Observed 5 packages of buskut (baked sweet bread) available for retail sale with store label providing only name of food item and price. Person in charge (PIC) stated that a lady makes the item at home and unsure if she is registered under cottage food with the state of Arizona. All food must be obtained from an approved source as defined by law. Buskut packages were true embargoed at time of inspection. Items shall not be sold until verified they are from approved source. Corrective Action: Correct prior to re-inspection. 3 day re-inspection required.

Observed a hand held bidet attached to the water supply line for the establishment's toilet. The hand held bidet is a shut off style water sprayer attached to a hose that allows for the sprayer to rest attached to wall and removed when desired. Person in charge informed that due to lack of air gap for sprayer and it being a shut off style sprayer they must install a high hazard back flow device such as a RPZ (ASSE 1013) or a spill proof back flow preventer (ASSE 1056). All testable backflow devices must be certified. Provide an approved backflow device prior to re-inspection. Corrective Action: Correct prior to re-inspection. Re-inspection scheduled for 01/07/2025.
