Shut-offs, including chemical dispensers and sprayer nozzles, are not approved for continuous installation downstream from atmospheric vacuum breakers. Observed multiple egg burritos and breakfast sandwich (with cooked eggs and pork) measured 45-51'F in reach-in unit located opposite of coffee machine. PIC stated food items have been in unit for longer than 4 hours. Establishment gets food items in question from another permitted establishment but lacks the food production operational permit for wholesale of pre-cooked food items. PIC was informed of this and also suggested PIC to measure temperature of delivered food items to ensure they are received at 135'F and above or 41'F and below. All TCS foods improperly cold held were discarded by PIC at time of inspection. Except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. Eggs not treated to destroy Salmonellae can be stored in equipment that maintains an ambient air temperature of 45°F or below. Corrective Action: Corrected at time of inspection.

Observed 3-comp sink with sanitizer dispensing quat solution. Quat sanitizer test strips observed expired since 2023. PIC could not provide unexpired quat test strips at time of inspection. Observed chemical warewashing machine by 3-comp sink using chlorine as sanitizer solution. PIC stated establishment is out of chlorine test strips at time of inspection. PIC placed a work order for new test strips at time of inspection and stated test strips are expected to arrive on 09/18. Observed 3-comp sink quat dispenser and chlorine warewashing machine to be dispensing sanitizer solutions within approved concentrations (tested by inspector test strips). Test strips are required for any sanitizers used with food contact surfaces. Provide sanitizer test strips prior to re-inspection scheduled on 09/26. Corrective Action: Correct prior to re-inspection.

continued from Violation 3-201.11(A-B): Also observed breakfast sandwiches containing egg/bacon/sausage and green salsa for sale the PIC stated was made by In The Now. Sandwiches were labeled with ingredients and expiration date. Green salsa was observed in small, to-go type plastic containers with no labeling or date. PIC stated that temperatures are not taken when the products arrive onsite but that they seem to arrive “warm” and establishment then puts them in the fridge. Discussed with PIC that TCS items must be delivered above 135*F or below 41*F. Cooling process should take place in full by product manufacturer if going to deliver cold. Observed breakfast burritos from the company “In The Now” for sale in front point-of-sale fridge and in cold holding unit behind counter. The ingredients on the burrito label stated: “Birria, egg, potato, cheese, and crema”. PIC stated that “Birria” was beef birria. Birria burritos do not bare a label of inspection. PIC stated that products are made in a commercial kitchen, Stoop Kid, in Downtown, Phoenix by In The Now. PIC provided invoice for products. Invoice did not contain address for where the products are manufactured. All meat products made offsite must bear a label of inspection. Instructed PIC that items may not be sold at this time. Had PIC move all items to shelf in reach-in fridge near three comp sink to be kept onsite until further inspection. Product may not be moved, discarded, or otherwise tampered with. “In The Now Breakfast Burrito” containing birria is not an approved source as defined in statue, rule, or code. These products were embargoed in accordance with Chapter 8 of the Maricopa County Environmental Health Code. Paper embargo form provided to PIC at time of inspection.
