Observed the establishment selling in house made Bolis (Mexican Freezer Pops) as a grab and go item with most of them missing labels. All packaged food labels must include the following items: (1) the common name of the food, or absent a common name, an adequately descriptive identity statement; (2) If made from two or more ingredients, a list of ingredients and sub-ingredients in descending order of predominance by weight, including a declaration of artificial colors, artificial flavors and chemical preservatives, if contained in the food; (3) an accurate declaration of the net quantity of contents; (4) the name and place of business of the manufacturer, packer, or distributor; (5) the name of the food source for each major food allergen contained in the food unless the food source is already part of the common or usual name of the respective ingredient; (6) except as exempted in the Federal Food, Drug, and Cosmetic Act § 403(q)(3) -(5), nutrition labeling as specified in 21 CFR 101 -Food Labeling and 9 CFR 317 Subpart B Nutrition Labeling; and (7) for any salmonid fish containing canthaxanthin or astaxanthin as a color additive, the labeling of the bulk fish container, including a list of ingredients, displayed on the retail container or by other written means, such as a counter card, that discloses the use of canthaxanthin or astaxanthin. OC re-inspection for a Class 4 10+ E&D permit was conducted with manager Saul S. without an appointment. The establishment was open and operating at time of inspection. Please address the following items prior to the OC re-inspection within 10 days: 1) Provide chlorine test strips for the bleach sanitizer solution that is used at the three sink. 2) Relocate the fish tanks away from all food products. Observed them being stored on a display case for raw produce. 3) Indirectly plumb the sno cone machine to the floor sink with rigid piping and provide a 1" minimum air gap. 4) Replace the leaking three sink faucet. 5) Provide a hose bib vacuum breaker at the hose bib faucet located in the hallway. 6) Provide an NSF, commercial blender to replace the residential unit currently installed. The facility was instructed to stop vacuum sealing all seafood products and utilize only ziploc bags until ROP HACCP/Variance approval has been given by the Department. Please be advised that the New Business Permit Application fee includes one initial inspection and one follow-up inspection. OC inspection for a Class 4 10+ E&D permit was conducted with manager Saul S. without an appointment. The establishment was open and operating at time of inspection. This establishment/operation has demonstrated sufficient compliance to proceed with the issuance of the permit. To complete the permitting process, issuance of this permit, and begin operation, the applicant must first submit payment of the annual operating permit fee to the Department’s Administrative Services. Fees paid up to this inspection approval do not include the annual operating permit fee. PAYMENT with a credit/debit card can be made via phone at 602-506-6824, Option 2. Per MCEHC Chapter I, Regs 4 & 5, no person shall conduct an operation or operate an establishment for which a permit is required without holding the necessary and valid permit to do so. Payment with a credit/debit card can be made on-line via select “Pay a Fee” at esd.maricopa.gov.
