In the kitchen refrigerator, TCS foods such as spaghetti, noodles, and oatmeal had internal temperatures of 46*F-52*F. The PIC decided to voluntarily discard the items at the time of inspection rather than move them to another working unit. Per PIC, a large pot of hot beans placed in the unit may have caused the unit temperature to increase. Instructed the PIC not to use the unit until it is able to hold TCS foods at 41*F or below. Except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. Eggs not treated to destroy Salmonellae can be stored in equipment that maintains an ambient air temperature of 45°F or below.

In the kitchen refrigerator TCS foods such cooked oat meal, cooked spaghetti, and cooked noodles were not date marked. Per PIC, some items were made the previous day for use today or tomorrow. Reviewed the date marking handout posted in the kitchen with the PIC. The food items were discarded by the PIC because they were out of temperature. RTE/TCS foods requiring date marking must be date marked within 24 hours and sold or discarded after 7 days (including the day it was made as day 1).

The main kitchen refrigerator was not keeping TCS food at 41*F or below. Per PIC, this may have been caused by the large pot of beans placed in the unit to cool down. The min/max thermometer was reading at 60*F after being placed in the unit for more than 30 minutes. The PIC will use the top shelf of the refrigerator in the pantry area to store TCS foods until the unit is repaired. A re-inspection will be conducted to ensure the unit is repaired or replaced. A kitchen staff member came into the kitchen and donned a pair of gloves in order to serve food. The staff member failed to wash their hands prior to donning gloves. The PIC instructed the staff member to remove gloves and wash hands. Discussed the importance of proper hand washing and when hand washing is required with the person-in-charge (PIC). In the 3-compartment sink, one of the compartments is slow draining and the other compartment is clogged. Instructed the owner to contact a plumber to address the issue immediately. Instructed the owner to minimize the kitchen usage until the 3-compartment sink is repaired. The PIC will use disposable plates and pre-made food until the sink is repaired. All plumbing must be maintained in good repair at all times. In the reach-in refrigerator of the dry storage area raw shelled eggs and cooked beans had an internal temperatures of 51*F-52*F. The person in charge (PIC) verified the temperatures with the establishment's thermometer. The food items were embargoed and voluntarily discarded by the PIC at the time of inspection. The PIC stated this refrigerator will be not used to store TCS foods until it is repaired/replaced. If the refrigerator is replaced, it must be a commercial unit. Except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. During inspection an employee was observed putting on soiled/used gloves in order to serve pastries. The employee stated they ran out of gloves; therefore, they have to re-use soiled gloves. The person in charge (PIC) was informed of the issue and had employee remove gloves and wash hands prior to serving pastries. Since there were no gloves available, tongs and other utensils was used to serve pastries during the inspection and no bare-hand contact was observed.
