Upon reinspection all violations have been corrected. It has been determined that establishment can operate without remodel as long hood is removed prior to next routine inspection and no additions are added to the menu besides the PHO where the soup and beef product are heated and cooled, then assembled and heated for immediate service. Currently establishment is a class 2 and is required to move up to a class 3 in order to cool up to two items.Establishment is able to use up to two hot plates for boiling of soup and meat. No pan frying, frying, or grease/smoke cooking can be conducted at any time. No addition to the menu can occur that requires cooling or alternative cooking methods. Any grease, or moisture accumulation in the kitchen that is a result of preparing the pho without a commercial, approved hood system may result in requiring a remodel to add equipment deemed appropriate OR the removal of pho may be required.

Predefined Comment: Due to the violations noted on this inspection report, County legal action may result from this inspection.Observed non commericial hood and metal tube installed on the back wall of establishment over a hot plate with boiling meat and liquid. Person in charge has added pho to the menu and currently soup and raw meats are cooked on the pot. The non commercial hood is used to vent while cooking. Establishment needs to remove hood system OR submit for remodel application by 9/24/25. Establishment is currently a class 2 E and D, and is going above the limits of the permit class by cooking and cooling raw meats and broth. Establishment currently does not have the proper equipment to continue cooking as it does not have an approved commercial vent or cooking equipment. Remove Pho from menu OR submit for remodel application with class status change from 2 to 4 by 9/24/25. Predefined Comment: Upon inspection, a remodel has taken place which may require an application and plans to be submitted, and/or additional permits. Please submit an application, supporting documentation, and fees within 5 business days or legal action may result pursuant to MCEHC Chapter 1, Regulation 4(e). Applications with supporting documentation can be submitted via the customer portal "Permit Center" online at maricopacountyaz-energovweb.tylerhost.net/apps/selfservice#/home. Predefined Comment: MCEHC Chapter 5 Section 1 Regulation 2(a): No person shall install any public water supply system or make additions, modifications or alterations thereto which involve a change in the plant, works, system, or sources of supply, until design criteria and complete plans and specifications for the work, together with the plans review fee, have been submitted to and have received the approval of the Department. MCEHC Chapter 5 Section 1 Regulation 3: No water system covered by those regulations shall be operated or maintained in Maricopa County without a permit in force, issued by the Department. Observed four packages of dried seasoned beef and dried seasoned squid in silver and clear sealed bags. Per person in charge the item was purchased from a distributor who repacks the items. The items did not have any brand, contact, or manufacturing location on the labels. Receipts could not be obtained for the products. Products voluntarily discarded at time of inspection. Corrected at time of inspection.

Observed container of cooked boba pearls, without time as control indicator, sitting on counter of kitchen area. Per Person in Charge (PIC), cooked boba pearls were under time as control and discarded every 4 hours. PIC was not able to provide written documentation of when boba pearls were removed from temperature control. Time as a Public Health Control requires written procedures detailing process for Time as a Public Health Control and time-stamping for items actively held under Time as a Public Health Control. All TCS foods being held under time as a control were properly time stamped at time of inspection. Corrective Action: Corrected at time of inspection.

Upon re-inspection, re-inspection violations have been corrected.The food embargoed (jerky and snack packs) during the previous routine inspection conducted on 05/06/2024 will remain embargoed and recommended for discard. Owner was unable to obtain receipts/invoices for the purchased food items. The embargoed items that had been segregated in the back storage room were removed from the establishment during time of inspection. The foods may not be sold to customers.Seven remaining 5-gallon purple paint buckets with flammable labels contained black tea leaves were observed in the back storage room during time of visit. Per owner, tea buckets had not be discarded yet, were not sold to customers, and were being held in the back storage room. The 5-gallon buckets were removed from the premises during time of inspection. F, had not had temperature checked today, and were placed on embargo and recommended for discard. Display cooler had an ambient air temperature ranging between 47 to 50 Deg. F. Owner lowered temperature setting during inspection, which lowered to 41 Deg. F by end of inspection. Ensure cold held TCS foods are held at or below 41 Deg. F. Per owner, those buckets had not been used for some time and any items inside buckets should have already been discarded.
