Observed raw chicken at bottom of reach in refrigerator near fryer holding at 53 degrees Fahrenheit at time of inspection. After 30 minutes chicken was still reporting at 53 degrees. Except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. Eggs not treated to destroy Salmonellae can be stored in equipment that maintains an ambient air temperature of 45°F or below. PIC confirmed that food had been loaded into refrigerator over 4 hours prior, early in the morning. Per PIC, they did not know how long the food had been out of temperature. All TCS foods improperly cold held were discarded by PIC at time of inspection. Corrective Action: Corrected at time of inspection.

Commissary agreement has not been provided in permit files since 2022. PIC did not have copy of agreement available during inspection. Per MCEHC, mobile food establishments shall provide a commissary agreement to the Department upon request, at permit issuance or renewal, and as a part of the documents submitted during plan review for a new permit. Corrective Action: Correct prior to re-inspection.

In tall reach in refrigerator, carton of raw shell eggs stored over tortillas and uncovered container of raw jalapenos were stored over packaged raw beef. Raw shell eggs were moved to bottom shelf and raw vegetables were moved above raw beef. All raw animal proteins must be stored below ready-to-eat (RTE) foods and stored according to cooking temperature at all times to prevent cross contamination. PIC properly stored all raw animal proteins according to the final cooking temperature based on the cooking parameters in § 3-401.11 of the Food Code. Corrective Action: Corrected at time of inspection.
