Inspector's notes

PIC did not have logs documenting commissary visits at time of inspection. Mobile food establishments serving time/temperature control for safety foods shall maintain a log of visits to the approved commissary or food service establishment as required by this Department going back 30 days. Instructed PIC to begin cataloguing visits and present them at re-inspection. Corrective Action: Correct prior to re-inspection. MCEHC Chap. 8, Sec. 3, Reg. 5c - Mobile food establishments shall provide a commissary agreement to the Department upon request, at permit issuance or renewal, and as a part of the documents submitted during plan review for a new permit. Ice cream vendors that only sell or dispense individually packaged, commercially processed items are exempt from providing a commissary agreement. Addl Notes: No current commissary in files for unit at time of inspection. Old commissary closed for non-payment and agreement expired as of 6/1/25. PIC confirmed they had switched commissaries to another restaurant and visited every day they were in service. Unit was also parked there when not in service. PIC was told to submit an updated commissary agreement with new establishment with the completion of their renewal paperwork by 8/18/26. Per MCHC, Mobile food establishments shall provide a commissary agreement to the Department upon request, at permit issuance or renewal, and as a part of the documents submitted during plan review for a new permit. Corrective Action: Correct prior to re-inspection.

Inspector's notes

Observed cooked beef (51°F, 50°F, 60°F), cooked chicken (54°F, 60°F), cooked rice (47°F), and shredded mozzarella cheese (53°F, 50,°F) all holding in reach in refrigerator reporting above 41°F at time of inspection. Except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. Eggs not treated to destroy Salmonellae can be stored in equipment that maintains an ambient air temperature of 45°F or below. PIC confirmed meat had been cooked on unit the day prior and placed in cooler overnight; PIC could not say when rice and meat went out of temperature. Mozzarella had been moved from refrigeration at 41°F at commissary to unit within last 3 hours. All TCS foods improperly cold held other than the cheeses were embargoed by PIC at time of inspection; cheeses were relocated to alternative functioning refrigeration unit to rapidly cool to 41°F at time of inspection. Corrective Action: Corrected at time of inspection.

Observed prep table fridge by patio entry holding at 48°F minimum after half hour. Other prep table by front entry observed off and nonfunctional. Cold holding equipment must have the capacity to maintain TCS foods at 41°F or below. Must repair cold holding equipment such that it maintains TCS foods at 41°F or below. All TCS items were either removed to another fridge or embargoed for improper cold holding. PIC had 2 alternate refrigeration units in good working order. PIC must provide documentation confirming fridge is able to hold at 41°F or below by 8/10/26. Corrective Action: Correct prior to re-inspection.

This prohibition does not apply to foods that have been prepared or packaged in permanent food establishments or commissaries meeting the requirements of this code. Addl Notes: PIC confirmed that cooked meats were prepared on unit grill on previous day of service, then were cooled in prep fridge overnight for service. Cooling is not permitted on mobile units and must be done at the unit's commissary in a walk in refrigerator. Items improperly cooled and held overnight were embargoed at time of inspection.
