Observed an employee who was shredding cooked chicken with gloved hands, touch a tablet to check a customer out with the gloves still on, removed the gloves and then placed a new pair of gloves on without washing their hands. Employee properly washed hands at handwash sink before touching cooked chicken. Discussed the importance of proper hand washing and when hand washing is required with the person-in-charge (PIC). Hands must be washed at any time contamination occurs and when changing tasks. Corrective Action: Corrected at time of inspection.

Observed no employee with the supervisory or management responsibility to direct food preparation with a Certified Food Protection Manager (CFPM) certificate. Employees were prepping and in direct contact with open Time/Temperature Controlled for Safety (TCS)/Ready-to-Eat (RTE) foods at time of inspection, thus requiring a CFPM to be present. Person-in-charge (PIC) advised that new deli manager would be placed through a CFPM class prior to next routine inspection. A CFPM is required to be on the premises during all hours of operation. #22 — Proper Cold Holding TemperaturesPriority3-501.16

Inspector's notes

Observed various whole cuts of packaged and unpackaged cooked meats including ham, turkey, chicken, and salami in left side of display cooler with internal temperatures ranging from 45-47°F. Packaged cheeses including provolone and Swiss were also at an internal temperature ranging from 45-47°F. Ambient temperature of display cooler was measuring at 50°F. PIC determined after checking breaker that condenser unit had tripped and reset breaker. PIC provided temperature logs from 11:20 am showing that products in the right side of the cooler were at 41°F or below. Based off of temperature logs, products were within the 4-hour cooling time limit and were transferred to walk-in cooler to rapidly cool. Except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. Eggs not treated to destroy Salmonellae can be stored in equipment that maintains an ambient air temperature of 45°F or below. All TCS foods improperly cold held were relocated to alternative functioning refrigeration unit to rapidly cool to 41°F at time of inspection. Corrective Action: Corrected at time of inspection.

Kitchen is shared by sushi bar and deli department. Wastewater from sink is not being drained into the floor sink and is overflowing onto the floor due to blocked line. PIC stated the hazard in question has been present since the night prior to day of inspection. A work order was filed at time of inspection and plumbing agent arrived on-site to begin the work order at time of inspection. Sewage must be properly conveyed at all times and waste lines must be maintained to accommodate use of sink fixtures draining to them. See following immediate suspension.
