Due to the violations noted on this inspection report, County legal action may result from this inspection.Establishment was observed operating outside the scope of their approved operating permit in violation of MCEHC Chap. 1, Reg. 4(a). In walk-in cooler, observed open packages of raw chicken, raw shrimp, raw beef, cooked rice, portioned bottles of mayo, prepped butter, open packages of tortillas, bulk boxes of raw in-shell eggs, and individual portions of cooked shrimp and rice. Owner claims that the food was held for a mobile food unit that parks adjacent to the establishment (could not locate permit information). Person in charge and owner of retail space was informed that the retail space has a Retail Food Establishment Class 2 Permit which is defined by the Maricopa County Environmental Health Code as "an operation that sells only pre-packaged food that requires time/temperature control for safety (TCS) and/or bulk food that does not require time/temperature control for safety." Establishment must cease holding open time/temperature controlled for safety foods at this permit. Person in charge voluntarily discarded all open TCS food items at time of inspection.

Observed the following open time/temperature controlled for safety food items stored in walk-in cooler: raw chicken, raw shrimp, pre-cooked wontons, cooked rice, portioned bottles of mayo, raw beef, prepped butter, open packages of tortillas, and individual portions of cooked shrimp and rice. Per owner, open TCS food was brought in from a mobile food unit that is parked outside. Person in charge could not verify approved source for food items. Inspector's notes

Observed the legs of the mop/hand sink in the bathroom to be made of unsealed wood. Discussed with PIC the importance of preventing organic matter growth and insect harborage. Informed PIC that the wooden legs need to be sealed. All facilities must be constructed so that they are smooth, nonabsorbent, and easily cleanable. Must repair all plumbing to a state of good repair prior to next routine inspection. Corrective Action: Correct prior to next routine inspection. 5-205.15 (B) - Core: System Maintained in Good Repair; Maintained Addl Notes: Observed the floor drain adjacent to the bathroom with organic matter growing in the drain and also the wall above it where the pipe is draining. Fix pipe so that it is directly draining into the drain and not dripping down the wall. Keep the floor drain free of organic matter growth. All plumbing must be maintained in good repair at all times. Must repair all plumbing to a state of good repair prior to next routine inspection.
