Observed non-functional open-top display prep cooler operating at 62'F via min/max thermometer at time of inspection. PIC stated that they are using 'Time as a public health control' to regulate the cut produce (tomatoes/lettuce) within the unit. PIC also mentioned that the unit has been non-functional for 1 week. Cold holding equipment must have the capacity to maintain TCS foods at 41°F or below. Must repair cold holding equipment such that it maintains TCS foods at 41°F or below. A reinspection will occur on or prior to 4/3/2025 to verify the correction. Corrective Action: Correct prior to re-inspection.

Observed TCS food condiments including cut tomatoes and cut lettuce in metal storage bins at 58F, asked person in charge how long they have been out for and he claimed they were out for about four hours. Informed the PIC that the food was out of temperature and had exceeded the four hour window to be used. PIC indicated that the TCS food was using time as control. Products were embargoed and PIC discarded the condiments at the time of inspection. Ensure that TCS foods are stored below 41F or are used within four hours.
