Observed 5 gallon container of chocolate with large spoon sticking out of the container and covered with a garbage bag under plastic lid cut out for the spoon. Person in charge (PIC) stated item is melted and used to refill a chocolate fountain. The 5 gallon container of chocolate had been sold to a customer for at home use with the unused chocolate returned to the bakery. PIC stated returned chocolate would be reused or resold. Returned food may not be re-used or re-served. PIC discarded container of returned chocolate at time of inspection. Corrective Action: Corrected at time of inspection.

Observed box of 145 whole eggs sitting at room temp. Eggs were to be used in large cake. Person in charge stated that eggs were purchased in the morning and have been at room temp since 6am, exceeding 4 hours. Internal temperature of egg was 80*F. Except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. Eggs not treated to destroy Salmonellae can be stored in equipment that maintains an ambient air temperature of 45°F or below. Explained to PIC that eggs are a TCS item and need to be stored in the fridge. Recommended using pasteurized eggs in the future which can stored at room temperature. All TCS foods improperly cold held were discarded by PIC at time of inspection. Corrective Action: Corrected at time of inspection.
