Current food permit does not permit cooking. All protein food must be precooked or cooked. Establishment is now opening at 10am.

Observed multiple raid cans and pesticide spray located by grease trap along with a couple dead cockroaches. All pest control for the establishment must be performed by a certified pest control specialist and chemicals for pest control must not be stored onsite. Establishment must be maintained free of pests and all pest control measures must be conducted by a licensed pest control specialist. Must eliminate current pest control problem and obtain pest control from a certified and licensed pest control specialist. PIC removed pest control chemicals from premises at time of inspection. Observed prep fridge in the corner across the cash register to have an ambient temp of 48*F. Unit held cut melon, cut watermelon, pineapple and other fruit. Informed the staff to have unit repaired and until then, keep cut melon in alternative unit. All equipment must be maintained in good repair at all times. Refrigerators shall be 41*F or lower to store RTE/TCS foods. Repair all equipment to a state of good repair prior to next routine inspection. Corrective Action: Correct prior to next routine inspection.

Discussed with person in charge (PIC) that time/ temperature control (TCS) foods such as watermelon and horchata must be cold held at 41*F and below or 135*F and above. PIC turned on water faucet for dipper well. Observed ladle used for nacho cheese in metal container with room-temperature water in steam well. Observed sign in restaurant stating they sold home made ice cream and observed several unlabeled bins of different flavors for sale. Spoke with owner via phone and stated that he mixes ice cream batter mix at home in ice cream machine. Discussed with owner that establishment cannot sell TCS (time/temperature control for safety) foods, such as ice cream, made at home. Seven ice cream bins (strawberry, chocolate, rompope flavored) were embargoed at time of inspection and placed in back freezer and labeled "not for sale". Discussed with employees that embargoed ice cream cannot be sold. Owner stated he is out of town but will discard home made ice cream when he returns for reinspection.
