In open air display refrigerator near the front desk observed commercially packaged yogurt, hummus, and charcuterie packs. Internal temperature of TCS foods measured between 52-53°F. Ambient temperature thermometer displayed temperature of 50°F and minimum temperature of unit measured between 46-48.7°F with inspector's min/max thermometer.

Predefined Comment: Except during preparation, cooking, cooling or when time is used as a control all TCS foods must be maintained at 41°F or below. Eggs not treated to destroy Salmonellae can be stored in equipment that maintains an ambient air temperature of 45°F or below. According to the PIC all TCS foods were in the unit at least since yesterday. Predefined Comment: All TCS foods improperly cold held were discarded by PIC at time of inspection. Instructed PIC to only store non-tcs foods and beverages in the open air display refrigerator until it maintains 41°F or below. Corrective Action: Corrected at time of inspection.

Predefined Comment: RTE/TCS foods requiring date marking must be date marked within 24 hours and sold or discarded after 7 days (including the day it was made as day 1). Predefined Comment: All RTE/TCS foods past 7 days of preparation were discarded by PIC at the time of inspection. Provided list of cheeses exempt from date marking. Observed cooked tortilla Espanola dated 5/18 in the bottom section of prep refrigerator on the line across from the grill. After discussion with the person in charge it was determined the Torilla Espanola was prepared and frozen on 5/18 (Day 1). It was determined the Espanola was thawed on 6/12 (Day 2). If ready to eat TCS foods are frozen, they should be labeled to include the date the food was prepared, the date the food was frozen, and the date the food was removed from the freezer to thaw in the refrigerator. The total time in the refrigerator cannot exceed 7 days. Predefined Comment: All RTE/TCS foods were properly date marked at the time of inspection. Corrective Action: Corrected at time of inspection. Repeat Violation: 2nd.
