Observed the water out of the hand-washing sink and the three compartment sink with light brown color. Discussed with operator that they cannot use the discolor water for hand washing and cooking. Operator was asked to close and have the water tank service. A permit holder shall immediately discontinue operations and notify the regulatory authority if an imminent health hazard may exist because or circumstance that may endanger public health. Corrective Action: Correct at once.

Observed both refrigerators unit with internal temperatures between 71-98 degrees temperatures. Per the operator, one of the refrigerators was not maintaining cold holding temperature at 41 degrees, but they had it repair the day prior to this inspection. Discussed with the operator that a permit holder shall immediately discontinue operations due to not been able to maintain cold TCS food due to cold holding capacity. Corrective Action: Correct at once.

Discussed with operator that mobile food preparation shall be simplified to reduce excessive steps where food may become contaminated. Operator corrected by reheating and placing on the hot table for hot holding. Corrective Action: Corrected at time of inspection.

Excessive steps may include, but are not limited to, cooking overnight without oversight, cooling, or cutting large volumes of food items. This prohibition does not apply to foods that have been prepared or packaged in permanent food establishments or commissaries meeting the requirements of this code.

Provide an updated commissary agreement to discharge wastewater. If planning to use this facility, ensure to obtain approval from the local jurisdiction for the wastewater disposal. A different permitted fixed food facility can also be used as a commissary. MCEHC Chap. 8, Sec. 3, Reg. 5c - Mobile food establishments shall provide a commissary agreement to the Department upon request, at permit issuance or renewal, and as a part of the documents submitted during plan review for a new permit. Ice cream vendors that only sell or dispense individually packaged, commercially processed items are exempt from providing a commissary agreement.
